The bench headed by Chief Justice of India Dipak Misra said: “Letustellyouverycandidly.We cannot allow single-judge benches (at NGT).” Justices A M Khanwilkar and D Y Chandrachud were the other judges on the bench. The rules of the NGT Act mandate the chairperson to constitute a bench of “two or more members consisting of at least one judicial member and one expert member”. However, as not enough appointments had been made, the Ministry of Environment, Forests and Climate Change in December last year issued a notification amending the rules to enable the constitution of a single-member benches “in exceptional circumstances”. The NGT Bar Association of the western zone in Pune challenged the notification in the SupremeCourt,sayingitviolated the NGT Act. Theapexcourthasnotatthis point quashed the government notification. The chargesheet was filed by Alwar police in the court of the Behror additional chief judicial magistrate on January 24. Following Khan’s lynching on April 1, police had registered two cases — one against Khan’s assailants for murder and another againstKhanandhiscompanions for ‘indulging in cow smuggling’. The WCD ministry is now looking at initiating changes to the legal framework to allow adult survivors to register complaints against the perpetrators at any stage in their lives. Instructions have already been issuedtoexaminetheProtection of ChildrenfromSexualOffences Act (POCSO), Indian Penal Code (IPC) and the Indian Evidence Act, a senior official told The Indian Express. According to results of the National Achievement Survey (NAS), released by the HRD Ministry last month, an average of 67.7 per cent of Class 3 students have performed well in language. This rate, however, drops to 58.4 per cent in Class 5 and 56.7 per cent in Class 8. The drop in overall learning levels in mathematics is even sharper.InClass3,itstandsat64.3 percentandfallssignificantly,almost by 10 percentage points, to 54.14 per cent in Class 5. It is the lowest in Class 8 at 42 per cent. For now, the HRD ministry has only released district-wise report cards from the survey, which covers 2.2 million students from 1.1 lakh schools across700districts.However,according to official sources, a preliminary analysis of the results shows that female students demonstrated better learning than males. 14 WORLD 2.2 million children across country were tested Forinstance,inmathematics, 64.4 per cent of female students in Class 3 performed well, compared to 64.1 per cent male students. In Class 5, the success rate of girls in the same subject was 54.32 per cent and boys 53.94 per cent. As for Class 8, 42.3 per cent of girls answered questions correctly, compared to 41.8 per cent boys. Another interesting revelationwasthatstudentsof government and government-aided schools in rural areas performed better than their counterparts in urban schools in mathematics, across all three grades. The finding is contrary to the perception that the quality of education in urban areas is superior to that in rural areas.
