Thisisthefirstcaseunderthe new ordinance where the agency will approach the court to seek an official declaration to categorise Mallya as a “fugitive” based on its prosecution complaint — charge sheet — filed under the Prevention of Money Laundering Act (PMLA). In the loan default case of the defunct airline, sources told The Indian Express that the current worth of attached assets is higher than the amount, including interest, that Mallya is said to owe a consortium of 17 banks — around Rs 10,000 crore. If the court declares Mallya a fugitive under the new ordinance, his assets in India and abroad will be liable for confiscationandcanalsobesoldtosatisfycreditors’claims,evenbefore the trial begins. Once ED moves the court, Mallya, who is currently fighting extradition in UK, will be given six weeks to present himself at “a specified place at a specified time”. Official sources told The Indian Express that the US team, which will include lawyers, and policy and technical experts, is scheduledtomeettheIndianexperts from Monday to Wednesday. They said that the US officials will try and address Indian observations on the draft Communications Compatibility and Security Agreement (COMCASA) submitted earlier. The resumption of talks on COMCASA signals a breakthrough in the Indian stance. After signing a military logistics agreement with the US in 2016, the Indian government was not keen on signing the two other “foundational” agreements — COMCASA and Basic Exchange and Cooperation Agreement for Geo-spatialCooperation(BECA). COMCASA essentially provides a legal framework for the transferof communicationsecurity equipment from the US to Indiathatwouldfacilitate“interoperability”betweenIndian and US forces — and potentially with other militaries that use US-originsystemsforsecuredatalinks. ItwascalledtheCommunication and Information on Security Memorandum of Agreement (CISMOA) before the name was changed to reflect its India-specific nature. At this rate, the association estimates, India will consume 14 exabytes (or 1 million TB) of data per month in five years, compared to 1.3 exabytes last year. Telecom Regulatory Authority of India (TRAI) numbers show that an average mobile subscriber consumed almost 2,000 MB or 2 GB data per month. And with fixed WiFi networks, usage shot up to 8.5 GB per month, according to Nokia. A TRAI report in April estimated that WiFi will drive about 60 per cent of Internet traffic in 2021. Both RailTel and Google said their initiative was just the beginning of more connectivity projects. “The reality is that when we conceptualised the entire thing, it was unbelievable to have WiFi broadband in one of the toughest places in India — railway stations,” Google’s Suri said. The project ran into initial engineering difficulties with electrical interference and heritage preservation of century-old stations. In 2016, RailTel began linking optic fibre cable that follows the railway tracks to the roofs of train stations, as Google — often with the help of third-party implementors — began designing and deploying station access points.
